This clarification is in response to a news item entitled 'SHC dismisses SSGCL suit against KE' published in Business Recorder issue of October 16, 2019.
"At the outset, it is erroneously mentioned that Sindh High Court (SHC) has dismissed the suit for recovery and damages worth Rs. 55 .70 billion filed by Sui Southern Gas Company Limited (SSGC) against K-Electric (KE). This information is contrary to the Order dated 7 October 2019 by the Hon'ble High Court and has created a stir at the ministry level and the Pakistan Stock Exchange, since SSGC is a public listed company.
"From the bare perusal of the order dated 7 October 2019, it is ex-facie evident, that the SSGC's suit for recovery bearing No. 1641 of 2012 is a very much pending adjudication before the Hon'ble High Court of Sindh and only two of the interlocutory applications filed by SSGC were dismissed. However, SSGC and its counsels are reviewing its legal position to avail appropriate legal remedy against the said order.
"Although at a later part of the news item, it was stated that the Hon'ble Court has dismissed two of the interlocutory applications filed by SSGC, but the pendency of recovery suit against KE was nowhere stated in the news. It is reiterated that vide Order dated 7 October 2019, the Hon'ble Court has not dismissed the Suit for recovery filed by SSGCL against KE, and the same is still pending for adjudication/ trial."
