Justice Chaudhry Ijaz Ahmad of the Lahore High Court (LHC) has observed that inaction of public functionaries is not consonance with the mandate of the constitution which is not a healthy sign, and in such circumstances the country will fall in chaos.
The learned judge further observed that constitution is social binding contract between the people of Pakistan and organ of state and everybody whosoever is bound to obey the command of the constitution. The society can only run smoothly by providing justice to the people.
The judge, while disposing of petition filed by one Afzal Ahmed, directed the Chief Secretary Punjab to issue necessary instructions to the public functionaries to decide the applications of citizens promptly without any fear, favour, nepotism, with reasons and within reasonable time and formulate a policy in this regard also.
The court also directed the petitioner, who approached the court against the revenue officials for encroaching upon thoroughfare in his village illegally, to appear before the District Co-ordinating Officer (DCO) who will decide the matter within three months in accordance with the law either himself or through any competent authority and submit his report to the court.
The court further observed that Pakistan is founded on the basis of Islam, efforts should be made to bring about an egalitarian society based on Islamic concept of fair play and social justice.
State functionaries are expected to act fairly, justly and for the advancement of the justice, in a manner which should not give to anyone any case of complaint on account of discriminatory treatment or otherwise, coupled with the principle that no one suffer on account of the act of the authority.
