The Lahore High Court (LHC) while issuing stay in a petition filed by Wapda Employees Co-operative Housing Society (WECHS), directed the Gujranwala District Co-ordination Officer (DCO) to submit his reply within a fortnight.
The petitioner society contended that housing society was surrounded by a boundary wall. The respondent Ajula Associate Town Developers decided to construct a road and approached the respondent DCO for demolishing the houses situated in the housing society as encroachment.
The respondent DCO issued orders for demolishing the houses without hearing or taking the petitioner in to confidence. The petitioner society has neither set up encroachment over any area nor acted illegally. The petitioner society approached the respondent with the request to act in accordance with the law but they ignored the petitioner's representation and ordered demolishing of the houses. The petitioner, therefore, prayed to the court to direct the respondents not to demolish the houses situated in the petitioner society and also direct the respondents to act in accordance with the law.
The court, after hearing the petitioner's counsel at length, stayed the proceedings against the petitioner society and directed DCO Gujranwala to submit reply within a fortnight.
