The Lahore High Court (LHC) has dismissed an appeal filed by Rana Sajjad challenging the decision of the LHC single bench directing him to hand over her daughter to British High Commission official for her custody to her mother in Scotland.
The petitioner has approached the Supreme Court of Pakistan instead of availing remedy of filing an appeal in LHC. The petitioner's daughter Misbah Iram had come to Pakistan to live with her father without consent of her mother. Her mother, therefore, approached the LHC for her custody. The Lahore High Court single bench had allowed the petition on the ground that the respondent violated the commitment made before a British court that he would stay in Scotland.
