The Central Board of Revenue (CBR) has dismissed Mazhar A Nurani, a BS-20 officer of customs and excise group on charges of corruption. According to a CBR notification issued here on Monday, Nurani was taken into custody under National Accountability Bureau (NAB) Ordinance in reference No 67/2002.
The Accountability Court-I, Rawalpindi/Islamabad held the accused guilty of offence under Section 9(a) IV and V read with Section 10, 14 and 15 of National Accountability Ordinance 1999 and consequently convicted and sentenced him to nine year R I with a fine of Rs 2 million or else to suffer further RI for one year in case of default.
The accountability court also ordered forfeiture and confiscation of the immovable property ie, plot No 77, Orchard Nursery Scheme, Murree Road, Islamabad measuring 4.38 acres and land measuring 99 kanals in village Mohra Noor Tehsil Islamabad district except House No 52-A Satellite Town, Rawalpindi. All the Bank accounts held in the name of accused and Surrya Nurani, all bank lockers, prize bonds valuing Rs 8,00,000 and golden ornaments weighing 70 tolas to have been retrieved from locker held by Surrya and two vehicles were also seized, forfeited and confiscated to the State.
Under Removal from Service (Special Powers) Ordinance, 2000 a person in government service on conviction by a court of law on charges of corruption or moral turpitude is liable to dismissal from government service with effect from the date of his conviction by a court of law.
Under second proviso to Section 3(2) of the Removal from Service Ordinance opportunity of Showing Cause shall be given where the accused is dismissed under clause (a) of sub-section Accountability Court-I, Rawalpindi/Islamabad.
Therefore, no show cause notice is required in this case, the notification said.
The competent authority ie, Prime Minister, after examining the entire record of the case, has imposed major penalty of "Dismissal from Service" upon him under the said Ordinance with effect from October 5, 2004 ie, the date of pronouncement of judgement by the accountability court.
Nurani will have a right to appeal under the Removal from Service (Special Powers) Ordinance, 2000 within 15 days from the date of communication of this notification.
