A lobby, striving for reinstatement of former Chief Justice Iftikhar Muhammad Chaudhry is hatching conspiracies against Chief Justice Abdul Hameed Dogar to defame him, said Nawaz Kharal, President of Federal Capital Lawyers Forum (FCLF) here on Wednesday.
Addressing a press conference at Supreme Court, he asked for initiation of contempt of court proceedings against the organisation which published allegedly fake news item regarding award of extra marks to the daughter of the Chief Justice in violation of the laws. The FCLF would lodge contempt petition if it was not done by the court, he added.
He alleged that some people (supporters of Justice Iftikhar Muhammad Chaudhry) were using these tactics to bring him back. Kharal said that statements issued by Aitzaz Ahsan and other lawyers, who asked for resignation of Justice Abdul Hameed Dogar, proved that they had accepted him as constitutional CJ. Justice Abdul Hameed Dogar had taken the oath under the constitution and he will complete his tenure as Chief Justice of Pakistan, he added.
"It seems as if these people (Aitzaz Ahsan and others) are ignorant of law, as it is the right of every student to ask for re-assessment of his/her examination results', he said. Kharal said CJ's daughter did not ask for any unconstitutional favour, rather she exercised her right, and applied for reassessment as a citizen of Pakistan, along with some 200 other students.
Referring to the news item which said that Federal Board of Intermediate and Secondary Education (FBISE) by awarding extra marks to the daughter of CJ has not only violated its own rules but some judgement of the Supreme Court as well. He said that re-assessment was done according to the laws laid down by the board and it did not violate judgements of the SC.
In order to substantiate his argument, he cited the judgement: 2004 SCMR 606, Muhammad Usman Qayyum versus University of Engineering and Technology, and said that the FBISE did not violate the SC judgement. He criticised the media for propagation baseless information to the masses, saying that it should not toe the line of someone, rather it should perform its duties irrespective of any bias and discrimination.
