Former MPA Aslam Madhyana's case: LHC division bench refers petition to CJ

A division bench of the Lahore High Court (LHC) referred a petition to chief justice filed by former MPA Mian Aslam Madhyana, seeking deletion of section 7 of Anti-terrorism Act 1997 in a case against him for its disposal by some other bench.
On Monday, it came up for hearing before the bench comprising Justice Rauf Ahmad Sheikh and Justice Shahid Hameed but Justice Rauf Ahmad Sheikh declined to hear the case due to personal reasons and forwarded the matter to the LHC chief justice for formation of a new bench. Madhyana's counsel Azam Nazir Tarar had already completed his preliminary arguments.
Petitioner counsel submitted that the allegations levelled against Madhiana proved false, as a medical board has given opinion that injuries were not caused to the teacher by firearm weapon. He, therefore, prayed to the court to issue directions to the ATC not to try the petitioner under terrorism charges. He also requested to stay the proceedings of the trial court till final decision of this petition. Complainant schoolteacher Nafees Ahmad in the FIR alleged that Madhiana with his stooges, attacked him after he raised an objection against his criminal acts.
