Pakistan Chemicals and Dyes Merchants' Association Chairman Mohammed Sabir Chippa said on Thursday that its members discharge more than 95 percent sales tax liability at the import stage and have to go through a series of problems for less than 5 percent of the remaining sales tax liability.
Collector Sales Tax Enforcement Khawaja Tanveer Ahmed held meeting with chemicals and dyes business community at and lauded PCDMA chairman's efforts for getting the Association members' names from black list and assured that no blacklisting would be done without prior intimation to the PCDMA and without assigning reason.
Welcoming the guests the Chairman expressed thanks for accepting his invitation for the meeting and said that he was very impressed by the Collector's interest in resolving the members' problems.
The Sales Tax Enforcement Collector, accompanied by Additional Collector Manzoor H. Memon discussed at length the agenda presented by Chippa.
The PCDMA chief said: "I am highly indebted to express our profound thanks and appreciation over the gesture of sending us the advance list of 85 units, including our member firms, prior to initiating their cases for inclusion in suspected/suspended list.
In this connection, I must suggest that merely return of undelivered mail through TCS may not be considered a criterion for blacklisting any firm. Rather it may be routed through our Association.
Furthermore, we request your kind clarification that should the invoices of our members issued during the period of their inclusion and deletion to and from suspected/suspended units' list would fall under STGO No 6/2003."
The Chairman inquired about harsh language of section 37 notices without specifying the buyers issued with fake/flying invoices and harassment thereof non-adherence of unanimously agreed parameters of audit for importers as per CBR letter: The Chairman desired to allow PCDMA members who wish their audits to be conducted at the Association.
Matters pertaining to Investigat-ion Audit with Prosecution latitude: Investigation Audit is usually carried out without any justification. It requires expert opinion.
Delay in granting refund under section 66 of the Sales Tax Act 1990 in respect of input not claimed in term of section 7 due to oversight: We look forward the accelerated processes of such cases of our members.
After reading out the agenda, the chairman quoted a newspaper report that CBR member (Audit) Syed Perwaiz Amjad, while speaking at Lahore Chambers of Commerce on February 17 had said that CBR had empowered the sales tax collectors to accept even the lesser level of value-addition because every business carries probability of losses as well. It is a welcoming statement.
The Chairman's address was followed by presentation of Association Crest to the Collector by him, Vice Chairman Shaukat Hussain and Market Leader Ajaz Ellahi Magoon.
Former Chairman and Convenor PCDMA News Bulletin Sub-Committee also presented annual report and bulletin copies of Khuwja Tanveer Ahmed and Manzoor Memon.
In his address, the Collector Sales Tax Audit responded to all agenda points.
He explained technical reasons of every irritant brought to his attention and said that he has been highly impressed by the way PCDMA chairman followed up chemicals and dyes business community's cases that also led to thoughts to inform the Association prior to any harsh action so that it may confirm its members enabling that sales tax to keep them aside form such action and initiate necessary action after taking the association into confidence.
