A division bench of High Court of Sindh (SHC) comprising Justice Wahid Bux Brohi and Rehmat Hussain Jaffery on Tuesday issued bailable warrant of arrest against Javed Akhtar Pirzada in the sum of Rs 300,000.
The bench was hearing a reference made by trial court (District and Sessions Court, Central) for cancellation of bail of the accused who is facing trial in murder case of Justice Nizam Ahmed (Retd) and his only son Nadeem Ahmed.
Both the victims were gunned down by unidentified gun men in 1996 allegedly over a property dispute.
Asif Ali Zardari, husband of former Premier Ms Benazir Bhutto, Baber Sindhu and Bilal Shaikh are other accused in the case.
When the case was called, Court noted that SHO Ferozabad was not present. On a query, Assistant Advocate General (AAG) Sindh Habib Ahmed sought time to inquire about the said officer. The bench kept the matter aside allowing time to AAG to summon the concerned SHO.
Later, the matter was taken up again. SHO Aurangzeb appeared along with Sub Inspector Police Qamar-uz-Zaman and tendered unconditional apology.
He informed the court that summons were entrusted to said Sub Inspector Police Qamar-uz-Zaman for service. Another summon for attachment of surety submitted by one Saghir Fatima was also entrusted to him and out of confusion, he went to the trial court.
The bench accepted the apology with the order to the police officer to remain careful in future. The bench also directed him to make efforts for locating the accused who apparently went under ground. AAG Habib Ahmed informed the bench that accused has jumped bail and is not traceable.
The bench after hearing the AAG issued bailable warrant of arrest of the accused in the sum of Rs 300 000.
The reference was made by the trial court as the proceedings were deferred several times due to the absence of Javed Akhtar Pirzada.
