Defending auction of Americano plot in Saddar area, the City District Government Karachi (CDGK) on Friday said the auction of the plot had been held after the order of Sindh High Court. Filing counter affidavit before SHC in Sindh government application against the auction of plot, the CDGK counsel Manzoor Ahmed prayed court to dismiss the application as the case had already been decided by the court with the consent of both parties and CDGK had taken action strictly according to the order of High Court.
The Sindh Government challenged the auction of plot by CDGK; contending entire auction proceeding was void as judgement of court was obtained by concealing the facts. It argued under Sindh Local Government Ordinance (SLGO), the local government land could only be auctioned for a period not exceeding five years.
CDGK stated there were so many applications filed by the plaintiff and thereafter Constitutional petition and other suit was also filed and the case had been finalised on admission of plaintiff putting plot into open public auction for 99 years lease.
Rejecting allegation of fraud, it said the statement had been filed by District Officer and identified by EDO (Law) being the legal authority, Therefore, there was no question of fraud or misrepresentation arose in order. It further stated the application was not maintainable under the law as government had no concerned with land as well as proceeding of suit in question, therefore, neither government was necessary party nor competent to enter in the proceeding.
Today, when the matter was taken up, Additional Advocate General (AAG) Kazi Khalid Ali told the court that Advocate General Sindh Anwar Mansoor Khan would appear himself in that matter and requested adjournment.
