SHC allows MPA's petition, sets aside KU's letter

A division bench of the Sindh High Court comprising Chief Justice Sayyed Saeed Ashhad and Justice Maqbool Baqar on Wednesday allowed petition of Malik Imran Khan Member NWFP Provincial Assembly from PS-75 Lakki-II and set aside all letters and show cause notice issued to him (Malik Imran) by University of Karachi.
Barrister Kamal Azfar submitted before Division Bench that Karachi University on May 31, 2003 declared that degree awarded to his petitioner Malik Imran Khan MPA was forged on the basis of which Deputy Director Anti Corruption Department Sindh issued a certificate on June 2, 2003.
He stated subsequently University also served petitioner with letter on March 27, 2004 and show cause notice on April 15, 2004 calling upon Malik Imran MPA to surrender his degree with threats of actions. The letters and show cause notice was assailed in suit 432 of 2004.
He further submitted that no opportunity of hearing was provided to the petitioner MPA thereby rendering their actions illegal and without lawful authority.
The Division Bench set aside all letters and show cause notice and directed Karachi University to hold proper enquiry with notice to petitioner providing him opportunity to absolve himself. Since cause of action to file suit has become infructuous, it would also be withdrawn.
