SHC orders issuance of contempt notices to SPCBL

A division bench of the Sindh High Court, comprising Justice Sarmad Jalal Osmany and Justice Azizullah M Memon, ordered to issue contempt notices to Saudi Pak Commercial Bank Ltd (SPCBL) on contempt plea filed by First Prudential Modaraba, First Pak Modarba and their management companies, and fixed May 4 for hearing of contempt application. Salam Ansari, advocate for petitioner Modarabas, contended before the division bench that by virtue of consent order dated March 29, 2005, in presence of deputy prosecutor general NAB and counsel of SPCBL, order of releasing/defreezing of accounts of First Pak Modarba, as well as First Prudential Modarba and their Modarba Management Companies, was passed by the High Court.
After passing defreezing order, when the cheques were presented the same were dishonoured upon presentation with remarks "account freezed" and "matter sub-judice", which was contempt and disobedience of order of the court, falling within preview of Article 204 of Constitution.
The division-bench, after preliminary hearing directed to issue contempt notice to Saudi Pak Commercial Bank Ltd, for May 4 when contempt petitions would be heard along with other pending applications. Shaukat Hussain Zubedi, Deputy Prosecutor General NAB appeared for NAB.
