The Central Board of Revenue (CBR) has transferred and posted 12 Deputy Commissioners of Income Tax (DCITs) as senior law officers at the Regional Tax Offices (RTOs) in all major cities of the country.
Sources told Business Recorder on Wednesday that the CBR would soon announce the names of 24-25 more law officers of customs and excise group to be appointed at the regional collectorates. Law officers of indirect taxes would be selected and subsequently posted at the collectorates of sales tax and federal excise and collectorates of customs.
The selection of law officers of income tax group has been made on the basis of strict criteria to ensure disposal of cases at tribunals, high courts and Supreme Court. The department has preferred grade-18 tax officials, who are law graduates. These officers have ample experience of dealing with cases at the level of higher courts.
The law officers' job description revealed that they would have to keep liaison with the departmental representatives as well as legal advisors.
Secondly, it is the duty of the legal officers to ensure that the cases do not get time barred. They will be responsible to maintain list of cases at tribunals, high courts and Supreme Court and law officers would keep track of hearing of cases so that the departmental representatives should not miss the hearings at the higher courts.
Legal officers will also be given powers to appoint the lawyers in consultation with the Board and Law and Justice Division if required. The CBR will also give assignment to these officers to conduct monitoring of the adjudication cases on regular basis.
