LHC returns petition after three months

The Lahore High Court (LHC)'s office has returned a petition to the member of Lahore High Court Bar Association (LHCBA) after three months of its filing wherein prayer was made to the court to direct respondent government to bring back the body of Chaudhry Rehmat Ali.
The petitioner M D Tahir had filed the petition before the summer vocation, but LHC office has now returned the petition for being not maintainable. The LHC office has also returned some other petitions filed by the petitioner on some important issues.
LAW OFFICER SUMMONED: Lahore High Court has issued notice to law officer to appear before the court on December 13 to assist on the point whether Chief Minister could allot public land to private persons without holding an open auction.
The court observed this in a petition filed by one Muhammad Iqbal challenging decision of the Chief Minister for allotting a piece of land to one Abu Bakar. The petitioner through his counsel contended before the court he was running a nursery for last 30 years and was paying all necessary revenues to the government. He said the respondent Chief Minister without any lawful authority had allotted the said land to his favourite Abu Bakar.
He said the court had issued a status quo order but the respondent while ignoring the court orders destroyed his nursery and occupied the land in question. He said a sessions judge had also submitted his report that the respondent had destroyed his nursery, but the respondent police officials failed to take any action against the respondent Abu Bakar. He, therefore, prayed to the court to declare the allotment orders issued by the respondent chief minister as illegal and without lawful authority. He also prayed to the court to direct the respondent police officials to get restored the land in question.
PLEA TO BAN KITE FLYING: A member of the Lahore High Court Bar Association has sent a record of deaths caused by kite flying to the Chief Justice of Pakistan and prayed that kite flying and its manufacturing should be banned forever.
M D Tahir in his letter along with the necessary documents informed the court how the kite flying had damaged Wapda and caused killing of innocent citizens.
He also prayed to the court to direct the respondent high police officials to implement the court orders of ban on kite flying in letter and spirit.
PLEA DISMISSED:
The Supreme Court of Pakistan on Friday, while dismissing a petition, observed that trend of involving all family members in murder cases should be discouraged.
The court passed these observations in the petition filed by Muhammad Younas, who approached the court against Maqsood for converting his life imprisonment into death penalty.
The Lahore High Court had converted the death sentence of said prisoner in to life imprisonment, as four other accused were exonerated by the trial court by giving them benefit of doubt.
The court observed that people involve innocent persons in a murder case without giving any consideration, which creates problems for them.
It further observed that neither our religion nor law allows any innocent person to be involved in a criminal case.
Later the court dismissed the appeal being time barred. SSP ordered The Lahore High Court (LHC) has directed SSP Lahore to produce detainees Abdul Majeed and his two brothers before the court on November 28.
The court passed these orders in a petition filed by Mst Allah Rahim who approached the court for recovery of her husband and his two brothers. The petitioner contended police in some criminal cases required her husband. She was on her way along with her husband from Sehwan Sharif when a police contingent stopped them and arrested her husband and his two brothers also. She apprehended the police would kill them in fake encounter. She prayed to the court to direct respondent police officials to act in accordance with the law and produce them before the august court.
The court, after hearing petitioner's counsel at length, issued notices to the respondents and directed SSP Lahore to produce the detainees before the court on next date of hearing.
