Dr Sohrab Sarki was not in custody of police, said a counter affidavit submitted by SP Muhammad Aslam before a division bench of High Court of Sindh (SHC) here on Thursday.
The bench was hearing a constitution petition filed by Muneer Ahmed Sarki, brother of alleged detenue who maintained in the petition that when raiding or arrest party was leaving the premises, he inquired from a person about his identity who told him that he was Muhammad Aslam, Nooruddin Sarki advocate, counsel for petitioner later maintained before the bench that detenue was in custody of an agency and has been detained at Napier Barracks.
The Standing Counsel present on court notice undertook to ascertain about the allegation from concerned quarters. The bench after this statement by Federal representative put of further hearing by consent till March 22.
The same bench also adjourned hearing of another detention matter pertaining to alleged illegal custody of Engineer Wali Muhammad Rahimoon till March 22 after statement by Additional Advocate General Sindh Sarwar Khan.
Earlier, the state side submitted counter affidavit about the alleged detenue. According to one affidavit, detenue was facing a case of being in possession of four pints of Vodka and one kilogram charas. Upon a query by the bench, AAG sought time to inform the bench about any other case registered or pending against the detenue.
The petitioner Dr Bilquis Wali Muhammad filed the petition alleging that her husband was a victim of political rift.
