The Lahore High Court (LHC) has adjourned the proceedings in a petition filed by the family member of former Prime Minister Nawaz Sharif challenging the excessive demand of income tax raised by the respondent department, as the petitioner counsel did not appear before the court.
According to the details, the income tax department during the regime of Benazir Bhutto had demanded excessive amount of income tax from the petitioner Nawaz Sharif family. The petitioner had challenged the matter before the Income Tax Tribunal and the excessive demand of income tax slashed by the tribunal.
The Income Tax department again raised the demand and the petitioner challenged it before the court.
The court also ordered medical examination of the detainee who was tortured severely by the respondent ASI. The court advised the wife of the detainee to appear before the DPO along with the court orders, medical report and report of bailiff. The court further directed the DPO to take disciplinary and departmental action against the respondent ASI and submit his report to the court within two weeks.
The respondent ASI had kept the detainee in his illegal custody for 10 days and also tortured him severely. The court bailiff had recovered the detainee from his illegal detention and submitted a report before the court. The court, after hearing the petitioner's counsel and examining the bailiff report, called for report within two weeks.
The accused has been facing the charges of provoking the people for holding a violent protest on February 14 in Lahore.
The court passed these orders when law officer sought time to submit his reply to the petition.
The petitioner M D Tahir advocate contended the former Prime Ministers Benazir Bhutto and Nawaz Sharif had taken a large number of people for performing Umrah on government expenses which caused damage to public exchequer worth millions of rupees.
It was contended the action of the respondents was illegal, unconstitutional and without lawful authority and against the national interests. He, therefore, prayed to the court to direct the respondents to return the money they spent on the Umrah of their favourite persons.
