01 Sep, 2006

Senior Civil Judge Karachi Malir, on Thursday dismissed stay applications filed by eight engineers of Civil Aviation Authority against decision of CAA's Departmental Promotion Committee (DCP) and its implementation. Plaintiffs sought injunction against decision of DPC order in promotion matters.

The court was prayed to restrain CAA and its directors to suspend the operation and implementation of Departmental Promotion Committee order.
The court after hearing case observed that without recording evidence or further case proceedings the functioning of an important public department could not be disturbed or interfered.
The court also observed that plaintiffs must have prima facie case, balance of conveyance and irreparable loss in their favour but the said ingredients area missing in present case and dismissed stay application of plaintiffs. Izhar Bukhari advocate appeared for plaintiffs while Faisal Kamal, Arshad Hussain advocates and Obaidur Rehman Abbasi represented CAA.
