LHC restrains father from taking Misbah out of courts jurisdiction

A division bench of the Lahore High Court (LHC) while staying all the proceedings initiated in the petition filed by Scottish woman for the custody of her daughter Misbah Irum, has restrained from taking her out of the court jurisdiction.
The court also restrained Misbah and her other family members from giving interview to media meanwhile. The court issued notices to the respondents for December 8 and directed the petitioner counsel to assist the court on the maintainability of the petition on next date of hearing.
The court passed these orders in an intra-court appeal filed by Sajjad Rana father of Misbah Irum challenging the decision of a single bench of the august court allowing the petition of Misbah's mother with directions to hand over the custody of Misbah to her mother through British High Commissioner. Earlier the petitioner counsel contended before the court that the respondent court did not hear the petition on merits of the case.
He said that Misbah did not want to live with her mother but court ignoring the children right directed to hand over to her mother. The court, after hearing the petitioner's counsel, directed him to submit his submissions on the point of maintainability of the petition and rose for the day.
