A full bench of the Federal Shariat Court (FSC) has admitted 12 identical petitions for regular hearing raising law point whether the court is empowered to dissolve a marriage of a woman by 'Khula' without the consent of her husband. It has been contended in the petitions that the court has no power to dissolve the marriage bond without the consent of husband.
The full bench comprising Chief Justice Haziq-ul-Khairi, Justice Allama Dr Fida Muhammad Khan and Justice Salah-ud-Din Mirza will proceed with the petitions at principal seat and provincial branch registries. The point of views of religious scholars, lawyers and jurist consultants on the subject will also be heard apart from the standing counsels of the federal and provincial governments.
