Federal Tax Ombudsman (FTO) Justice(R) Munir A. Sheikh has asked the CBR to decide the case of the complainant in accordance with the provisions of law. This decision was taken by the Federal Tax Ombudsman (FTO) on the complaint of Latif Cotton Mills Limited, Karachi, against Sales Tax Department, Karachi, for refund claim.
The FTO recommended to the CBR to direct the Collector of Sales Tax to examine and scrutinise the documents and if the admissibility of the remaining amount was established, reopen the case under section 45A of the Sales Tax Act and on the basis of new evidence produced and pass order of sanction of the rejected amount.
The FTO also ruled that the action be completed within 30 days and compliance in this regard be reported to this office within 45 days. He also ruled that in the event of this action, the complainant would withdraw his appeal.
