Supreme Court Bar Association (SCBA) Member Mohammad Azhar Siddique has taken up a case in the Lahore High Court against the Election Commission for issuing a notification saying President Pervez Musharraf could take part in the elections while holding the post of Chief of Army Staff.
The petitioner has asked the court to refrain the President from inviting application or issuing schedule permitting any body to seek election to the office of the President of Pakistan who did not possess the requisite qualification. He also prayed to the court to refrain the respondent from issuing such notifications or taking such acts, which abridged the fundamental rights.
