Gem, jewellery merchants file petition under TOO

06 Oct, 2007

A constitutional petition under article 199 has been filed in the Sindh High Court by All Pakistan Gem Merchants and Jewellers Association Chairman Ubaid Ullah Qadri, seeking registration of his association and issuance of new license under Trade Organisation Ordinance 2006.
Ministry of Commerce (MoC) Secretary and MoC Director General have been cited as respondents in the petition. Petitioner Ubaid Ullah Qadri has submitted that the High Court had passed an order back in 2005 that Director Trade Organisation (DTO) decide the petitioners representation within one month, as the affairs of the association were not being run accordingly and election of 2005-2006 were not conducted but shown bogusly.
The petitioner has attached copies of letters written by him and order passed by the High Court, and stated that the respondents had not paid any attention to his applications, particularly those sent on May 4 and 23, for issuance of new license. He has contended that both respondents have failed to fulfil their legal official obligations due to which not only the petitioner but also the whole gem and jewellers industry was suffering.
The respondents are neither permitting election in petitioner's association to enable it function legally nor issuing new license. The petition has been filed, as no other remedy was available.
