Jamaat-i-Islami files review petition against dual-office verdict

Jamaat-i-Islami through its Amir Qazi Hussain Ahmed on Wednesday filed a review petition in the Supreme Court against the judgement of nine-member larger bench of the apex court, which held petitions challenging General Musharraf eligibility to contest presidential poll and his dual office non-maintainable .
On September 28, the larger bench of the court after hearing the arguments of both the parties, had dismissed the petitions as non-maintainable with the majority view of 6 to 3.
General Pervez Musharraf and Federation of Pakistan through Secretary Law, Justice and Parliamentary Affairs have been made respondents in the review petition. The petitioner also requested the court for constitution of full court to hear the review petition.
"This court has fallen into errors of fact and of law apparent on the face of the record which can be said to be self evident, floating on the surface and have material bearing on the final result of the case involving the enforcement of Fundamental Rights guaranteed under the Constitution", said the petition.
The review petition said that order of the court was a non-speaking order for the reason that no ground has been given on the basis of which the petition has been found not maintainable.
