Federal Tax Ombudsman (FTO) former Justice Munir A. Sheikh on Thursday directed Federal Board of Revenue (FBR) to issue delayed certificate and refund the amount to an importer. He took the decision on the complaint of M/s G.A. Parekh and Sons, Karachi against Model Customs Collectorate PACS, Karachi.
FTO asked FBR to issue the certificate within seven days, ensure maximum relief to complainant and the amounts remitted by the two agencies refunded to him within 30 days.
The later had issued a show cause notice to former, order in original and the subsequent re-examination of goods causing unnecessary demurrage and container detention charges on the consignment of motorcycle parts imported by the complainant from China. The FTO ruled that custom officials had acted against law and departed from the established practice of allowing re-examination.
"It was an arbitrary and unjust decision, resulting in additional duty and taxes, storage and detention charges," a press release quoted FTO. He also observed that the complainant was also entitled to remission of additional expenses paid to terminal operator and shipping agent.
