The Lahore High Court has ordered SP Model Town to register a case against Amir Farhan husband of Dr Shazia for illegally detaining his US national wife and two minors and misbehaving the court bailiff.
The judge issued this order while hearing a habeas corpus petition filed by Mst Nusrat Uzma Pirzada seeking recovery of her sister Dr Shazia along with two minors from the custody of her husband Amir Farhan.
Earlier on Wednesday, Muhammad Anwar, the bailiff, produced Dr Shazia and her nine-month old daughter Aliza after recovering them from the custody of Amir. The bailiff also produced Yousaf Nadeem, father of Amir, who was apprehended while trying to escape with Aliza.
The bailiff in his report said when the raid was conducted at the home of the respondent he misbehaved with him and refused to obey court's orders. Amir also got himself, his wife and the minors locked in a room and his father Yousaf disallowed the bailiff to search the house.
Later the SHO concerned was called who reached the spot and got Yousaf arrested with the minor Aliza when he was trying to flee from the scene. However, respondent Amir disappeared from the house along with five-year old Zaeem. The judge summoned SP Model Town and SHO Faisal Town police station and ordered them to produce Zaeem before the rising of the court.
Meanwhile the judge also ordered the police to arrest Yousaf who misbehaved the court bailiff and refused to hand over the minor to her mother. The court also issued contempt of court notices against him.
At 2pm the SP turned up to tell the court that a police party conducted raid at respondent's house but he closed the doors and did not allow police to enter the house. The police officer requested the court to order registration of a case against the respondent so that police could act forcefully for the recovery of the minor detenue.
