Islamabad High Court has directed Capital Development Authority (CDA) to decide an application filed by Accurate Builders and Constructors Private Ltd seeking NOC for Gulshan-e-Rahman Housing Scheme, within one month.
The court also directed CDA that while deciding the application, it should also take into consideration the statement made on its behalf before the National Assembly Standing Committee on Planning and Development on December 19, 2006. It also directed the Authority to apprise the court about its decision.
The Single Bench of Justice Mohammad Munir Paracha issued the directions on a writ petition filed by Maulvi Ahmed Sagheer Shahzada through Syed Mutahir Imran Bukhari. He apprised the court that Chairman Accurate Builders had submitted a revised layout plan of Gulshan-e-Rahman Housing Scheme, with CDA on June 30, 2004 for issuance of NOC but it was informed that the proposed site fell in the area declared by the Ministry of Defence as buffer zone.
He said that the request had been pending with CDA and the civic body should be directed to consider their case. He said during a meeting of National Assembly body, CDA had admitted that the issue of the said housing scheme was resolved and they had not objection over the issuance of NOC.
