A petition challenging the decision of Islamabad High Court (IHC) which had dismissed the bail plea of former Lal Masjid chief cleric Maulana Abdul Aziz was filed in the Supreme Court (SC), here on Monday.
Advocate Shaukat Aziz Siddiqui, counsel for Maulana Abdul Aziz filed the petition against the verdict of IHC which had rejected the bail plea of the cleric in a case of alleged forcible occupation of Children Library.
The case was registered by the Islamabad Police against Maulana Abdul Aziz after students of Jamia Hafsa took over the Children Library, adjacent to the mosque.
Maulana Abdul Aziz was arrested on July 3, during 'Operation Silence' against Lal Masjid and Jamia Hafsa and 27 anti-terrorism cases were registered against him.
Trial courts had already acquitted Maulana Abdul Aziz in 26 out of total 27 cases. The counsel contended that the criminal sections inserted in the FIR were baseless and irrelevant. He pointed out that the court had already granted bail in four major cases. These cases include kidnapping of Chinese nationals, police personnel and murder of Ranger personnel.
The petitioner prays that Maulana Abdul Aziz did not have direct involvement in the alleged occupation of the Children Library. The library has been razed to ground by the government, therefore, the case should also be closed and the cleric should be granted bail.
