The Sindh High Court (SHC) summoned Muhammad Saleem, Senior Civil Judge and Additional District and Sessions Judge (ADJ) in a constitutional petition challenging the orders issued by the judges without jurisdiction. The petitioner had challenged the order passed by Senior Civil Judge dated 11-9-2008 and by ADJ on 19-3-2008 and said they were without jurisdiction.
These orders, he continued, were encroachment on powers of a banking court because respondent M.Saleem had obtained finance facility. The petitioner also maintained that the respondent who obtained a loan from the bank filed a suit against the petitioner bank and since the relationship between respondent M Saleem and petitioner was of a borrower and customer, therefore the dispute between them could not be decided by the civil court. The bench after hearing initial arguments issued pre-admission notice to the respondents for September 9.
