Govt versus judiciary

12 Jul, 2010

The Supreme Court verdicts on the 18th Amendment and the NRO cases will have far-reaching consequences on the overall working of the government machinery. The government and the judiciary are moving on a collusion course and this clash can be averted if both the institutions remain within the parameters of their jurisdiction.
The proceedings in the court and the attitude of the government foretell that there is no possibility of peaceful co-existence between these two pillars of the state. In the absence of mutual trust, goodwill and complete understanding both the state organs are heading towards confrontation and this will result in greater confusion and uncertainty in the country. God forbid, if this happens, then it would be a sad day for Pakistan.
The government should realise the consequences which will arise in non-compliance of Supreme Court orders and desist from taking harsh decisions, which will provoke the Supreme Court to use its judicious powers to over-run the government directives. Sanity demands sober action and rule of law. Any deviation from this stand will land the government in trouble and bring fresh issues, which will have no readymade answers to solve. The country is already in a state of war with terrorists and all its energies are being utilised towards total elimination of this menace hence the country is not in a position to focus its attention towards fresh issues.
