Chief Justice of Pakistan/Chairman Judicial Commission of Pakistan, Iftikhar Muhammad Chaudhry on Monday chaired a meeting to establish and operationlise the Judicial Commission of Pakistan (JCP) under Article 175-A of the Constitution. The Chief Justice held consultation with Justice Javed Iqbal and Justice Mian Shakirullah Jan, the two senior most judges of the Supreme Court, over nomination of members of Judicial Commission.
The Judicial Commission as envisaged under Article 175A, will have composition of Chief Justice of Pakistan as its chairman with two senior most judges of the Supreme Court, besides a retired judge of the apex Court. During the consultation, nomination of a former Chief Justice or former Judge of the Supreme Court of Pakistan as Member for a term of 2 years under Article 175A (2)(iii) was discussed in detail and considered various names for the position and unanimously resolved the name of former Justice Ali Hussain Qazlibash.
While for nomination of former Chief Justice or Judge of Lahore High Court as one time Member under Article 175(5)(iv)-1st Proviso, the members discussed the issue of retirement of the incumbent Chief Justice of Lahore High Court due on 8.12.2010. Therefore, the process of appointment of the Chief Justice of that Court has to be taken in hand under the 1st Proviso to Clause IV of sub Article 5 of Article 175-A of the Constitution.
The members had thorough deliberations and considered various names, and finally had unanimous agreement in nominating Justice Mian Allah Nawaz, former Chief Justice, Lahore High Court as one time member for meeting of JCP for nomination of Chief Justice of the Lahore High Court to the Parliamentary Committee under Article 175 (8).
It is further stated that on the direction of the Chief Justice/Chairman JCP, letters have been written to the Chief Justices of Federal Shariat Court and High Courts to take steps/measures necessary for constituting the National Judicial Commission of Pakistan.
Similarly, letters have also been written to Pakistan Bar Council and four Provincial Bar Councils for nominating the senior advocates and forwarding their names to the Registrar, Supreme Court of Pakistan to complete the composition of the Commission and for its notification in the Gazette of Pakistan.
