Lahore High Court Member Inspection Team (MIT) has been approached against a judicial magistrate Muhammad Irfan Anjum for obtaining a confessional statement forcibly from a boy Muhammad Arshad who was declared innocent by the investigation officer.
The applicant Usman Ali advocate submitted that the magistrate had been hearing a case wherein a poor and unclaimed boy Muhammad Arshad was also involved in a criminal case under section 281-A and 411 of PPC along-with other accused persons. According to the report submitted by investigating officer, all the accused persons were innocent.
The magistrate released all other accused on bail and disagreeing with the police report to extent of Arshad, did not charge sheet him despite a lapse of over 14 months. The lawyer alleged that the magistrate compelled the boy to confess his crime and forcefully obtained his thump impression on confessional statement and adjourned the case to April 21 for announcing the verdict. He therefore requested the MIT to take strict action against the magistrate and terminate his services for committing gross illegalities while dispensing justice.
