Hearing a petition of former president Muhammad Rafiq Tarar, the Lahore High Court (LHC) here on Thursday directed the government to submit record and reply about payment of his pay and pension from December 1st, 2001 to September 8, 2008.
The petitioner's counsel referring to the Supreme Court decision in a petition by Sindh High Court Bar's Association contended that he (petitioner) legally continued as president till September 8, 2008, when Asif Ali Zardari assumed the office of president. He said Tarar be given pension benefits also as former president by declaring Pervez Musharraf an unlawful president who came after him through unlawful ways, throwing the elected government at that time. He contended that promulgation of Emergency on October 14, 1999 had been declared to have no legal effect as per 18th Amendment bill, which amended Article 270 AA. So the order 2,3 of 2001, for his expulsion, also has no legal effect.
