Supreme Court dismisses HT members' identical petitions

The Supreme Court (SC) on Monday dismissed identical petitions filed by members of Hizb-ul-Tahrir seeking instructions to stop kidnapping of HT activities instead of referring to inquiry commission on missing persons.
A two-member bench comprising Justice Nasir-ul-Mulk and Justice Tariq Pervaiz was hearing the petitions of Kamran Yousuf Zai, Ehsan Dawar Khan, Professor Muhammad Hanif Qureshi and Muhammad Ismail Abid, whereas federation of Pakistan was made respondent through Federal Interior Secretary.
Counsel for the petitioners Umer Hayat Sindhu informed the bench that his clients were kidnapped in July 2011, contending that intelligence agencies were involved in the kidnapping. He prayed that the SC might address the matter rather than referring it to inquiry commission on missing persons.
Sindho pleaded that the formation of inquiry commission was incomplete because Federal Interior Ministry failed in appointing its chairman so far, adding that his clients' cases would be delayed if sent to the commission and the accused persons could take advantage of it. On the occasion, Justice Nasir-ul-Mulk said that the adjudication was still pending in the Islamabad High Court (IHC) and SC can not hear the matter till the decision of IHC.
While talking to media persons after the hearing, Sindhu expressed his concern over non-implementation of IHC verdict by the intelligence agencies which he said could be judged from the fact that Director General ISI has not submitted a written statement to the IHC so far.
