Petition against illegal detentions: Supreme Court overrules registrars' objections, admits petition for hearing

A three member bench comprising Chief Justice Iftikhar Muhammad Chaudhry Justice Khilji Arif Hussain and Justice Tariq Parvez heard the Civil Misc. Appeal No 05/2012, Ruhaifa Vs. Federation of Pakistan (Against the order of the Registrar of this Court returning the Constitutional Petition being not entertainable).
The constitutional petition has been filed under Article 184 (3) of the Constitution, wherein it was stated that three sons of the petitioner namely Syed Abdus Saboor, Syed Abdul Basit and Syed Abdul Majid and eight others were in the illegal confinement of the respondents since May 29, 2010 and out of them three have been killed in an unlawful manner and without any trial and due process of law.
Attorney General for Pakistan and Director (Legal) Ministry of Defence appeared on behalf of the Federation while Tariq Asad, ASC represented the petitioner. The C. M. Appeal was allowed, office was directed to entertain the constitutional petition and fixed for January 30, 2012. Notices to Attorney General for Pakistan, Advocate General KPK and respondents were also ordered to be issued on Wednesday.-PR
