Waheeda Shah's petition: SHC orders status quo till May 15

25 Apr, 2012

A division bench of Sindh High Court (SHC) here on Tuesday ordered status quo in a petition filed by Syeda Wahida Shah against by-election, scheduled for April 26 in Sindh Assembly constituency (PS-53). The bench comprising Justice Aqeel Ahmed Abbassi and Justice Nisar Ahmed Shaikh was seized with the constitutional petition challenging the Election Commission of Pakistan's (ECP) verdict which disqualified her for two years and nullified the by-elections results.
The court issued a stay against the elections, which were slated for April 26 in PS-53 constituency in Tando Muhammad Khan till May 15 and also suspended the ECP's judgement against the petitioner till next date of hearing. Advocate Hyder Imam Rizvi, the petitioner's counsel, in his arguments cited judgements of the Supreme Court of Pakistan and SHC to corroborate his stance against the ECP's order. Deputy Attorney General Muhammad Ali Shaikh who represented the ECP argued that the petition was not maintainable because a lower court was also hearing the same case. The case was adjourned till May 15.
