Amendments in EOBI Act: bank's petition allowed by SHC

The honourable High Court of Sindh in a Constitutional Petition No D-1588 of 2012 in a case filed by Soneri Bank Limited, has declared that amendments made in the Employees Old Benefit Act 1976 through the Finance Act 2008 under Section 9 (4) - a Money Bill that is passed only by the National Assembly and not by the Parliament were - in violation of Article 72(3).
(a) to (g) of the Constitution, and as such, the claim made by EOBI extending the cover of the said law on the bank and the claim made by EOBI for payment for the period April-May 2012 were illegal as amendments made in the EOBI Act 1976 extending the said Act to banks and financial institutions were held to be ultra vires of the Constitution while Bank's petition had been allowed. Mahmood Abdul Ghani appeared before the court on behalf of Soneri Bank Limited.
