Khyber Pakhtunkhwa government urges Supreme Court to declare LHC decision null and void

02 Dec, 2012

The Khyber Pakhtunkhwa government has strongly objected the decision of the Lahore High Court regarding construction of Kalabagh Dam (KBD), terming it contrary to resolutions unanimously adopted by assemblies of three provinces and urged the Chief Justice of Supreme Court to declare the LHC decision as null and void by taking suo-motu notice of the matter.
"We had never supported the construction KBD because it was not a workable and feasible project after the opposition of three provinces, including Sindh and Balochistan, said Mian Iftikhar Hussain, provincial spokesman at a press conference here on Saturday.
Mian Iftikhar alleged that a certain group in Punjab was reinforced and supported on the unfeasible and non-workable project, aiming at to destroy three federating units, including KP, Sindh and Balochistan. "We strongly rejected the Lahore High Court decision asking the federal government to construction the controversial KBD as it was a technical issue not a legal one," he remarked.
He expressed the hope that people of Punjab would also oppose the decision. "We would not accept decision of such judiciary, which is not honouring the decision of other institutions," he maintained. After the passage of 18th Constitutional amendments, he said that dam would not be constructed without the consent of the provinces, which was against the spirit of the Constitutional amendments.
