21 Apr, 2013

Chief Justice Iftikhar Muhammad Chaudhry on Saturday constituted a three-judge bench to resume the hearing on identical petitions seeking directions for initiating high treason trial against former military ruler Pervez Musharraf for subverting the Constitution and imposing emergency in November 2007.
The bench of Justice Jawwad S Khawaja, Justice Khilji Arif Hussain, after the addition of Justice Ejaz Afzal Khan, will take up the matter on Monday (tomorrow). An application was filed by Musharraf's counsel Raja Ibrahim Satti for constituting a larger bench, seeking Chief Justice Chaudhry to consider important aspects of the matter and decide on the petitions.
While forming the bench, the Chief Justice in his order said: "On having taken into consideration discreetly the contents of the application and for the reason that two kinds of jurisdictions of the apex court have been invoked, therefore, in the interest of justice, a 3-Member Bench comprising Justice Jawwad S. Khawaja, Justice Khilji Arif Hussain and Justice Ejaz Afzal Khan is constituted for disposal of the cases referred to hereinabove."
