Giving proposals on judges' appointments in the superior courts, Chairman Judicial Activism Panel Mohammad Azhar Siddique emphasised a dire need for amending Articles 193 and 209 for determination of criteria for qualification and disqualification in line with Articles 62 and 63 of Constitution of Pakistan.
Talking to Business Recorder, Siddique said that in response to invitation of Sub-Committee/Parliamentary Committee on judges appointment in the superior courts, he proposed that there is no need for drafting amendment in Article 175 A. He also suggested that there should be amendment in Sub-Article 4 of the Constitution. He suggested the Committee that judicial commission has to nominate the names of the judges in view of the purposed amendment in Articles 193 and 209 of the Constitution.
"As far as nominations of judges are concerned for one appointment, three names should be proposed for appointment of a judge in judicial commission in a way that two names should be proposed by the judicial commission and one name by the parliamentary committee," Siddique said. However, he said that the prerogative to appoint a judge should be with the judicial commission.
