A division bench of Lahore High Court here on Wednesday sought a reply from the government and Election Commission of Pakistan (ECP) last week of September in an appeal challenging an amendment in Presidential election rules 1998. The petitioner, Azhar Siddique advocate, filed an intra court appeal (ICA) against the dismissal of his writ petition by a single bench.
A division bench headed by Justice Ijazul Ahsan argued before the bench that amendment was made to benefit General Musharraf (Retd) in the presidential election held in 2007. He said provisions of Articles 62 and 63 were applicable on all elections including the presidential. He argued the amendment was unconstitutional and aimed at favouring the military ruler.
