Death penalty applicable to facilitators, abettors, handlers of terrorists: LEGAL EXPERTS

25 Jan, 2016

Facilitators', found involved in helping out terrorists in terror attacks, are liable to death penalty according to law of the land, and those arrested by security forces for Bacha Khan University carnage will be dealt accordingly.
Salim Shah Hoti, a senior lawyer, on Sunday said that military courts were set up after the passage of 21st Amendment in January 2015 to proceed terror-related cases.
After lifting of moratorium on death penalty through an executive order by the Prime Minister after Army Public School carnage in December 2014, these courts were authorised to award death sentence to the facilitators, abettors and handlers of the terrorists without any distinction.
The Interior Ministry, he said, would send the case of the facilitators, arrested by the security forces for involvement in the carnage at Bacha Khan University, to the military courts for trial as the same law was applicable to them.
Ilyas Orakzai Advocate told APP though the death penalty law applied to the facilitators of terrorist attacks but there was an urgent need to create awareness in this regard as in some cases people mistakenly offer hospitality or give a ride to the suspect without knowing whom he was taking along.
Shabbir Khalil advocate said that facilitators should be tried under due process of law. The facilitators should be given counsel to defend his case in order to ensure fair trial, he added.
Mukhtiar Ali Advocate said that the legal fraternity did not support facilitators and their abettor but only wanted a fair trial. "We fully support execution of the facilitators and their handlers who wilfully extend support and assistance to Terrorists," he added.
Jawad Ali Advocate said law of land was clear about death sentence to the facilitators of the terrorists and called for proper publicity in this regard to make people aware of the issue.
