Territorial jurisdiction: LHC dismisses petition as withdrawn

02 Aug, 2016

A larger bench of the Lahore High Court on Monday dismissed a petition as withdrawn challenging territorial jurisdiction of LHC principal seat and its regional benches. The bench while dismissing the petition observed that the matter would be taken up in any other case later. The petitioner Shafi Muhammad had said that he did not want to pursue the case for time being and court dismissed the petition as withdrawn.
SCBA President Barrister Syed Ali Zafar who was appointed as amicus curie had argued that the benches of the LHC were established under the Constitution and there was no bar on any citizen from the territorial jurisdiction of LHC to directly approach its principal seat. The law officers and amicus curies were directed to come up with more arguments however the petitioner decided to withdraw his petition.
