'Removal from Service': FBR imposes major penalty on FBR official

The Federal Board of Revenue (FBR) has imposed major penalty of "Removal from Service" upon Dr Muhammad Aitzaz Ahsan Khan (PCS/BS-18, Deputy Collector, Model Customs Collectorate, Peshawar. According to a notification issued by the FBR on Wednesday, disciplinary proceedings were initiated against him under Government Servants (Efficiency & Discipline) Rules, 1973, on account of unauthorised absence from duty w.e.f. 27-02-2016 constituting "Misconduct" in terms of Rule 3(b) ibid.2.
The Authorised Officer/Member (Admn) keeping in view the obviousness of the charges and evidence available on record dispensed with the option of holding an inquiry under Rules 5(1)(ii) & 6 of the Government Servants (Efficiency & Discipline) Rules, 1973 and proceeded against the accused officer by directly issuing a show cause notice dated 13-05-2016 under Rule 5(1)(iii) ibid for imposition of one or more penalties including a major penalty of "Dismissal from Service".3. Whereas, the accused officer submitted his written reply to the show cause notice vide letter dated 09-06-2016 which was found unsatisfactory by the Authorised Officer/Member (Admn).
In his reply, the accused officer did not request for personal hearing, therefore, the Authorised Officer/Member (Admn) after having gone through the case record, recommended imposition of a major penalty of "Removal from Service" upon the accused officer, under Rule 4(1)(b)(iii) of the Government Servants (Efficiency & Discipline) Rules, 1973.
The Authority/Secretary Revenue Division granted hearing opportunity to the accused officer on 30-08-2016, however, he did not turn up for hearing on the aforementioned date.
The Authority/Secretary Revenue Division, after having gone through the case record and reply to the show cause notice, found Dr Muhammad Aitzaz Ahsan Khan (PCS/BS-18) guilty of the charge of "Misconduct" as levelled against him in the show cause notice and has imposed a major penalty of "Removal from Service" upon him, under Rule 4(1)(b)(iii) of the Government Servants (Efficiency & Discipline) Rules, 1973.
The period from 27-02-2016 to 06-09-2016 during which Dr Muhammad Aitzaz Ahsan Khan remained unauthorizedly absent from duty shall be treated as extraordinary leave without pay. Dr Muhammad Aitzaz Ahsan Khan (PCS/BS-18) shall have right of appeal to the Appellate Authority as provided under the Civil Servants (Appeals) Rules, 1977, FBR added.
