SC moved against military courts

The Wattan Party has approached the Supreme Court of Pakistan against the establishment of military courts under 23rd constitutional amendment. The petitioner, Barrister Zafarullah Khan of Watan Party, pleaded that the establishment of military courts is against the basic spirit of the constitution. He contended that Article 175 of the Constitution defines separate roles for executive and judiciary.
He therefore prayed that administrative officers cannot be appointed as judges. The petitioner prayed the court to strike down the 23rd amendment in the constitution for being extra constitutional.
