Services of two senior police officers: SHC upholds ad-interim order to suspend notifications

Sindh High Court (SHC) on Wednesday upheld the ad-interim order to suspend the notifications, issued by provincial authorities with regard to surrendering the services of two senior police officers in the province.

SHC passed ad-interim order on December 16, 2019 for suspending the operation of notification dated October 15, 2019 with regard to surrendering the services of Khadim Hussain Rind, DIG Police and the notification dated December 06, 2019 with regard to Muhammad Rizwan Ahmed Khan, SP District Shikarpur.

A division bench of SHC headed by Justice Muhammad Ali Mazhar issued the order in the petition, filed by civil society activists against the interference of Sindh Government in the transfer and postings of police officials. "Ad-interim order on December 16, 2019 for suspending the operation of notification dated October 15, 2019 with regard to surrendering the services of Khadim Hussain Rind, DIG Police and the notification dated December 06, 2019 with regard to Muhammad Rizwan Ahmed Khan, SP District Shikarpur is hereby confirmed", court order ruled.

Court also directed that no decision for surrendering the services and postings of Additional General of Police or Deputy General of Police shall be made without the meaningful consultation of Inspector General of Police, Sindh in terms of Article 13 of Sindh (Repeal of Police Act, 1861 & Revival of Police Order 2002), (Amendment) Act, 2019.

Court also ruled that the posting of Superintendent of Police and Assistant or Deputy Superintendent of Police shall only be made by IGP within the parameters of Article 17 of Sindh (Repeal of Police Act, 1861 & Revival of Police Order 2002), (Amendment) Act, 2019.
