A two-member bench of the Supreme Court on Tuesday issued notice to the Inspector-General of Police, Sindh, Syed Kamal Shah, to appear before it in person, and directed to submit report about the arrest of accused Abdul Karim in kidnapping case of two persons from Charpur, Larkana.
The Court comprising Chief Justice Nazism Hussain Siddiqui and Justice Tassadduque Hussain Jilani adjourned the case for two weeks and said that next date for hearing would be fixed later.
Additional Advocate General, Sindh, Qazi Khalid Ali, represented the provincial government as counsel of the petitioner.
Sheikh Mohammad Akram appeared as counsel of the respondents. Accused Abbas Ali was also present in the Court.
According to details of the case, accused Abbas Ali and Abdul Karim were involved in kidnapping-cum-ransom case of Abdul Khaliq and Abdul Waheed, owner and employee, respectively, of Arain Rice Mills.
It was alleged that both accused entered the premises of rice mills of Abdul Salam Arain located on Naoudero Road, Charpur, Larkana, in a white car along with other two persons, and kidnapped him at gun point.
Police registered an FIR against the accused under section 365-A and arrested both accused on October 14 in 1992 and October 2, 1992, respectively.
The accused released the hostages after a few months of their kidnapping and received an amount of Rs 700,000.
Both accused were awarded death sentence by the trial court. The court also ordered the state to forfeit all moveable and immovable property of both accused.
The accused filed an appeal before the Sindh High Court which acquitted them on September 19, 1995.
The Provincial government filed an appeal in the Supreme Court against the acquittal orders passed by Sindh High Court as impugned judgement in 1995 and prayed for the restoration of punishment awarded by the trial court.
The Supreme Court issued notices for the arrest of both accused. The Police arrested Abbas Ali, who was granted bail by the Supreme Court later, and Ahdul Karim was declared absconder.
District Police Officer (DPO), Larkana, Muzaffar Sheikh appeared before Supreme Court on Tuesday and submitted progress report about the arrest of accused Abdul Karim.
Expressing dissatisfaction over the progress report, the Bench issued notice to Inspector-General, Sindh Police, to appear before it in person.
