The fourth floor shall not be allowed to be constructed or be demolished if already raised, ordered a division bench of High Court of Sindh (SHC) comprising Chief Justice Sabihuddin Ahmed and Justice Muhammad Athar Saeed, here on Friday.
While hearing a constitution petition filed by Mian Sons Textile Limited against Lucky Textile Mills and Karachi Building Control Authority.
The petitioner moving the court maintained that due to illegal construction and activity of the respondents labourers at his mill were suffering from different problems and even a female worker fell unconscious.
When the matter came up for hearing before the bench on Friday, the counsel for respondents submitted that the building has been regularised by the KBCA. He submitted that the owners of the mills have paid Rs 3.7 million as a regularisation fee.
Shahid Jamiluddin, counsel for the KBCA, verified the fact and said that the KBCA has allowed regularisation of the building from ground plus three. The fourth floor has been declared illegal and demolished by the department, the KBCA counsel stated.
The bench after a detailed hearing declared ground plus three storeys as regularised while directing the KBCA that the fourth floor shall not be allowed to be constructed and if already raised than it shall be demolished.
The bench with the above order disposed of the petition.
