The National Tariff Commission has ended anti-dumping duty on import of polyester filament yarn from certain exporters of Indonesia, Korea and Thailand.
The step has been taken on the exporting companies' price undertaking, which would do away with the injurious effect of dumped imports. Following the investigations, the NTC had imposed anti-dumping duty varying from 3.67 to 29.68 percent on import of polyester filament yarn for 5 years from November 12, 2005.
After the final determination the following ten exporters/foreign producers have offered price undertakings under Section 46 of the Ordinance.
1) P T Polyfin Caggih, Indonesia;
2) P T. Mitra Lintas International, Indonesia;
3) P T Mitra Dutanusa Sejati, Indonesia;
4) P T. PanAsia Indosyntec Indonesia;
5) SAMS International Co Ltd, Korea;
6) Hanswill Co Ltd, Korea;
7) Toray Seahan Inc, Korea;
8) Chiem Patana, Thailand;
9) Siam Moderntex Co, Thailand; and
10) Tuntex (Thailand) Company Limited, Thailand.
After examination of the price undertakings offered, the Commission has decided to accept them, as the injurious effect of dumped imports from these exporters/foreign producers would eliminate.
The NTC has accepted the price undertakings for the following reasons inter alia:
i. The above-mentioned exporters/foreign producers have agreed to revise their prices so as to eliminate injury;
ii. The Commission is satisfied that the injurious effect of dumping in question would be eliminated after revision of prices.
iii. The domestic industry agreed that the Commission may consider the acceptance of price undertakings offered by the exporters/foreign producers.
