The Lahore High Court (LHC) while directing the law officer to assist the court on the point that no one except naib nazim could call the meeting of the council, has issued notices to the respondents for August 25 in a petition filed by Mian Muhammad Irshadullah Lalika, naib nazim tehsil Malikwal.
The petitioner contended that the respondent nazim of tehsil Malikwal requested him to call meeting of council for approval of annual budget. When the petitioner asked the nazim to attach copy of budget along with his request he instead of providing copy of the budget called the meeting of the council through presiding officer and got passed the budget. He also contended that the respondent nazim also got tempered the record, which was illegal and without lawful authority.
He prayed to the court to restrain the respondent government officials not to release the funds for implementation of the schemes passed in the budget meeting.
The court after hearing the petitioner's counsel Shaukat Nawaz at length admitted the petition for regular hearing and called for record of the council by August 25 and rose for the day.
Allows protective bail
The Lahore High Court (LHC) has allowed protective bail to one Raheel Ghaffar to enable him to obtain bail from a court of competent jurisdiction by August 31, 2006.
The petitioner contended that he deals with the sale and purchase of cloth. He submitted that the respondent, the Director General, Intelligence and Investigation (custom, sales tax and federal excise), Karachi, implicated him in a false case and sought his non-bailable warrants of arrest from the Court of Special Judge (custom & taxation), Karachi, and is ought to arrest him although he is not named in the FIR.
The petitioner contended that the case in question was registered against one Muhammad Zarat Khan on the charge of unlawfully claiming customs rebate through mis-declaration of description, quantity and value of consignment. He also contended that neither he was proprietor nor partner of any firm mentioned in the FIR.
He said that his name has been wrongly included in the said case during investigation by the investigating officer with ulterior motives on his part. He said that he wants to approach the court of competent jurisdiction for seeking bail, but the investigating officer is out to arrest him. He, therefore, prayed to the court to allow him protective bail enabling him to approach the court to competent court for bail. The court after hearing the petitioner's counsel, Mian Abdul Gaffar, at length allowed protective bail and disposed of the petition.
