The Chief Justice of Pakistan Justice Iftikhar Mohammad Chaudhry has observed that the Supreme Court may be approached after a decision on appeals of banned cricketers Shoaib Akhtar and Mohammad Asif by the Appellate Commission headed by Fakharuddin G. Ibrahim.
The Chief Justice made these observations on a petition filed by Maulvi Iqbal advocate who had argued that the PCB Anti-doping Commission (ADC) headed by Shahid Hamid exercised judicial powers without lawful authority.
He had prayed that as Coram was non-judice, arbitrary and having no legal effect, the ban imposed by ADC on these match winning, cricketers Shoaib Akhtar and Mohammad Asif be lifted and allowed to represent Pakistan in national and international tournaments.
The PCB appointed Anti-doping Commission had banned the 31-year-old fastest bowler in the world, Shoaib Akhtar for two years and the other young fast bowler, Mohammad Asif for one-year w.e.f. October 15, 2006, for testing positive on the use of banned medicines. Both bowlers have filed appeals against the ADC verdict, which would be heard by the appellate commission headed by eminent jurist Fakharuddin G. Ibrahim.
After hearing the petitioner's counsel in chamber, the Chief Justice observed: "The learned counsel does not press the matter at this stage as it may prejudice the appeals of Shaoib and Asif in the Appellate Commission. Needless to observe that the petitioner may approach again this court if he remains unsatisfied".
